Terms of Service
Effective Date: October 2026 • Version 2.4
1. Acceptance of Terms & Eligibility
By accessing or using the BitPaisaa platform, web services, or mobile applications, you affirm that you are at least 18 years of age (or the legal age of majority in your jurisdiction), possess the full legal capacity to enter into binding agreements, and are not barred from receiving financial or digital asset exchange services under applicable laws.
2. Nature of Platform & Automated Escrow Mechanism
BitPaisaa operates as a non-custodial matching platform and automated escrow facilitator connecting independent buyers and sellers of digital cryptocurrencies (such as USDT, BTC, ETH, and BNB) for peer-to-peer fiat settlements.
- Automated Escrow Lock: When a buyer initiates a trade against an offer, the seller's cryptocurrency is immediately transferred and locked inside the BitPaisaa smart escrow vault.
- Protection Against Fraud: Cryptocurrency locked in escrow cannot be withdrawn or returned to the seller until either the trade is completed or an authorized dispute resolution is concluded.
- No Direct Custody of Fiat: BitPaisaa does not handle, store, or hold fiat currency (INR/USD/EUR). Fiat currency is paid directly from the buyer's personal bank account/UPI to the seller's personal bank account/UPI.
3. User Verification & Anti-Money Laundering (AML) Compliance
To combat fraudulent activities, terrorist financing, and identity theft, BitPaisaa enforces strict Know-Your-Customer (KYC) and AML standards:
- All traders must complete identity verification, including government-issued photo ID verification and biometric facial liveness checks.
- Users may only maintain one verified primary trading account on the platform. Multiple accounts created for price manipulation or rate-limit evasion will be permanently terminated.
- BitPaisaa reserves the right to request enhanced due diligence (EDD) or proof of income for high-volume transactions.
4. Strict Prohibition of Third-Party Payments (Zero-Tolerance)
Sending payments from family members, business entities, friends, or third-party accounts is strictly prohibited. If a third-party payment is detected:
- The seller is instructed NOT to release the crypto escrow.
- The seller must refund the fiat payment back to the exact originating bank account (at the buyer's expense).
- The offending buyer's account will be suspended and reported for triangle fraud prevention.
5. Trading Rules for Buyers & Sellers
A. Buyer Responsibilities:
- Transfer the exact fiat amount agreed upon in the trade order within the specified time window (typically 15 to 30 minutes).
- No Sensitive Payment Remarks: Never write sensitive keywords such as "Crypto", "Bitcoin", "USDT", "P2P", or "BitPaisaa" in your bank or UPI transfer remarks. Doing so risks triggering automated bank freezes. Always use trade reference numbers or simple neutral remarks.
- Only click "Transferred, Notify Seller" after you have completed the bank transfer. Marking paid without completing the transaction constitutes a fraudulent strike.
B. Seller Responsibilities:
- Before releasing crypto from escrow, you must log in to your personal online banking portal or UPI app and confirm that the full amount has actually been credited and cleared.
- Never rely on SMS notifications, payment screenshots, or buyer chat promises alone. Fake SMS and spoofed payment receipts are common scam vectors.
- Once cleared fiat payment is confirmed, you must release the crypto within the allowed release window (typically 15 minutes).
6. Dispute Resolution & Arbitration Protocol
If an issue arises during a trade (e.g. buyer has paid but seller fails to release, or buyer marks paid without transferring funds), either party may raise a formal dispute after the timer expires:
- Our dedicated 24/7 Arbitration Desk will freeze the escrow and review the order chat, timestamped bank account statement PDFs, and video banking proofs.
- Both parties must provide authentic banking evidence within 12 hours of an arbitrator's request.
- The arbitrator's determination regarding escrow release or return is final and binding on both participants.
7. Platform Fees, Network Gas & Taxes
BitPaisaa offers zero-fee P2P marketplace trading for order takers. Maker ad postings, blockchain withdrawals, and hardware vault transfers may incur transparent network gas fees or platform maintenance charges as displayed prior to confirmation.
Traders are solely responsible for calculating, reporting, and remitting any taxes (including capital gains and TDS deductions) applicable to their cryptocurrency transactions under local jurisdiction laws.
8. Risk Disclosure & No Financial Advice
Cryptocurrency assets are subject to extreme market volatility, technical risks, and evolving regulatory frameworks. BitPaisaa does not provide investment, legal, tax, or financial advisory services. You trade at your own risk and discretion.
9. Account Termination & Blacklisting
BitPaisaa maintains a zero-tolerance policy against cyber fraud, chargeback abuse, harassment of counterparties in chat, and illicit financial laundering. Violations will result in immediate account termination, forfeiture of platform privileges, and reporting to relevant cybercrime authorities.
